Terms of Service

^{• Please allow up to 72 hours for response to your enquiries and commission requests}^{• The prices listed are subject to change depending on the complexity of the request.}^{• References must be provided when a commission request is sent.
The only exception made will be for the commission of a Reference Sheet where a written description will be acceptable.}^{• The quote you will receive is at my discretion and will not be open to bartering.
Any attempt to barter or argue the price will result in the termination of contact.}^{• All payments are via PayPal.}
^{I do not accept bank transfers, cheques, or cash.}^{• You will receive an invoice via Paypal once the commission has been accepted and will be added to the queue.}^{• For commissions below $100 (USD): payment will be upfront.}^{• For commissions above $100 (USD): a 50% deposit can be paid at the start and the remainder upon completion.}^{• Should no payment be received within 72 hours of the invoice being sent, you will be removed from the queue.}^{None of my artwork may be used with AI (either training or to be used in conjunction with my art), NFTs, or any projects relating to blockchain, crypto or web3.}

The Commission Process:^{• A sketch will be created and sent to you for your approval: demonstrating the composition, pose, and additional elements requested. Any correction can be implemented at this point, but no more than 3 re-draws will be made unless you wish to pay for additional sketches.}^{• Once approved, the line art will be created and submitted for your discretion.
Compositional alterations will not be allowed at this point. Small corrections to the character's shape, accessories, and other details can be implemented.}^{• Colour will be added following the references you provided, then shared with you for your approval. Only colours can be changed or altered at this stage.}^{• Rendering and finishing touches will be completed and sent to you for signing off.
If applicable: the remaining cost will be requested at this point.}^{• After payment has been made in full you will recieve the full-resolution, watermark free finished work via a Google Drive link.}^{• Any corrections that wish to be made after the commission is complete will be refused.}^{•You will have the right to use the artwork however you wish under a personal license.}^{Under no circumstances can it be used for commercial purposes .ie. Directly or indirectly in connection with any business or other undertaking intended for profit.
Examples include but not limited to merch, streaming, advertising, etc.}^{Please save your commission onto a personal computer or drive after recieving it.}^{• After the commission has been completed and sent it will remain in the drive for up to a week, and then be removed.
• After this point the artist is no longer liable for the security of the files.
• It is the responsibility of the person commissioning the artist to back up and care for the work created for them.}

Commission Turnover and Deadlines:^{• Commissions are completed within 1-4 weeks depending on the commission type.
• Turnover times for each commission type is available on the Commissions page.}^{Should there be a delay you will be notified directly before the turnover period is up.}^{• Deadlines MUST be discussed before the commission is started. Rush orders will incur a 20% to 50% cost increase depending on how tight the deadline is.}

Streaming:^{• The artist is an active member of Twitch and will stream their work.}^{• Should you want to keep your commission private, please notify the artist during your consultation.}

Refunds:^{• You can cancel your commission before work has started and expect a full refund.}^{• Should you attempt to cancel when work has started, you may receive a partial refund or none at all.}
^{• The amount returned is at the artist's discretion based on the time spent on your piece. This is non-negotiable.}

Harassment:^{Harassment of any kind will not be tolerated.}^{This includes but is not limited to:}
^{Bullying, badgering, exploitation, sexual advances, hate speech, homophobia, transphobia, proselytism, discrimination, threats of any kind, and verbal attacks.}^{Should this occur, you can expect the following:}^{• Your commission will be canceled, and no refund will be issued.
• You will be blocked on all social media.
• You will be black-listed and flagged as a dangerous client.
• Other artists will be made aware of your actions.}^{There is a zero tolerance policy for the aforementioned and will not be tolerated if such behaviour was to occur.}

Game Jams:^{Any assets created in collaboration with the artist Kittysoba may not be used outside of the stated project it was created for.}This means:
^{• Any asset that was created by Kittysoba during the period of a game jam is for that game jam alone.}
^{• You may use the assets created by Kittysoba for promotion of the project with credit to Kittysoba for said assets.}
^{• You may not reuse any assets created by Kittysoba in other projects outside of the project you were collaborating with Kittysoba on without express, written permission from Kittysoba.}
